TERMS OF SERVICE AGREEMENT

PLEASE READ THE FOLLOWING TERMS OF SERVICE AGREEMENT CAREFULLY. BY ACCESSING OR USING OUR SITES AND OUR SERVICES, YOU HEREBY AGREE TO BE BOUND BY THE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IT IS THE RESPONSIBILITY OF YOU, THE USER, CUSTOMER, OR PROSPECTIVE CUSTOMER TO READ THE TERMS AND CONDITIONS BEFORE PROCEEDING TO USE THIS SITE. IF YOU DO NOT EXPRESSLY AGREE TO ALL OF THE TERMS AND CONDITIONS, THEN PLEASE DO NOT ACCESS OR USE OUR SITES OR OUR SERVICES.

This Terms of Service Agreement is effective and updated as of 8/23/2025.

ACCEPTANCE OF TERMS

The following Terms of Service Agreement (“TOS”) is a legally binding agreement that governs the relationship with our users and others who interact with Creating Connections: Occupational Therapy and Wellness Services LLC, located at 69 Cummings Park Drive, Woburn, Massachusetts 01801, and our subsidiaries and affiliates, in association with the use of the Creating Connections website, which includes www.creatingconnectionsot.com (the “Site”), and our Services.

DESCRIPTION OF WEBSITE SERVICES OFFERED

The Site is a business site intended to inform users of services offered, including occupational therapy sessions, developmental and wellness programs, playspace bookings, staff, locations, contacts, and related offerings.

Visitors to our Site (“users”) may browse content, and once an individual registers for services through account creation, that person becomes a “member.”

The user and/or member acknowledges and agrees that all services provided through our website and related applications are the sole property of Creating Connections. We may update, modify, revise, suspend, or discontinue Services at any time, and your continued use of Services constitutes acceptance of such updates. Should you not agree, you must discontinue use immediately.

Furthermore, users and/or members understand and agree that Services are provided “AS IS,” and Creating Connections shall not be responsible for delays, missed delivery, deletion, or failure to store user content or communication settings.

PARTICIPATION RELEASE (Programs & Playspace)

I, the user (parent or guardian, if enrolling a child), hereby fully waive and release Creating Connections: Occupational Therapy and Wellness Services LLC, and its employees, officers, directors, affiliates, agents, representatives, successors, and assigns (collectively, “Releasees”), from any and all claims, demands, damages, costs, or causes of action (“Claims”) related to participation in any Creating Connections programs, therapy sessions, classes, or playspace activities, notwithstanding that any such Claim may have been caused in part by the negligence of the Releasees.

I agree to indemnify and hold harmless the Releasees from any liability arising out of or related to participation in services or use of facilities. By enrolling or participating, I acknowledge and accept this Release voluntarily and at my own risk.

PHOTO/VIDEO LICENSE AND RELEASE

I hereby grant Creating Connections and its successors, licensees, and assigns the non-exclusive right to use my (and/or my child’s) image, likeness, or voice in photographs or videos taken during programs, classes, or events. Such use may include marketing, promotional materials, social media, advertising, or educational purposes, without compensation or royalty.

I warrant that I have the authority to grant such rights and agree not to assert or maintain any claim related to such use.

REGISTRATION

To register and become a member, you must be at least 18 years of age to enter into a legally binding contract. Parents or guardians enrolling a child must provide accurate and complete information and certify that they are authorized to register the child for services.

By registering, you agree to:
a) provide factual, accurate, and complete information; and
b) update your information as needed to maintain accuracy.

WAITLIST POLICY

If a program, session, or playspace booking is full, users may join a waitlist. At the session start time, open spots are released to waitlisted clients in order of registration. Once added to the roster, members are subject to our Cancellation Policy.

CANCELLATION POLICY

Therapy Sessions: Cancellations must be made at least 24 hours in advance to avoid fees.
Playspace/Programs: Cancellations must be made at least 12 hours in advance. Late cancellations may result in forfeiture of the session fee or a late fee, depending on your membership type.

Member registration data and other personal information are strictly protected by our Privacy Policy (linked separately). By becoming a member, you consent to the collection, use, and storage of your information, as outlined in the Privacy Policy.

USERNAME AND PASSWORD

Certain areas of our Site may require a login. You are responsible for maintaining the confidentiality of your username and password, and for all activities conducted under your account. If you suspect unauthorized use, you must notify us immediately at info@creatingconnections.com.

We reserve the right to disable accounts if we believe these Terms are violated.

GENERAL STATEMENT ON LIABILITY

In no event shall Creating Connections be liable for direct, indirect, special, or consequential damages resulting from your use of our Site, booking system, or facilities, including but not limited to lost profits, data, or business interruption. All services are provided “as is,” without warranties, express or implied.

GOVERNING LAW

These Terms shall be governed by and construed under the laws of the Commonwealth of Massachusetts. You agree to submit to the jurisdiction of the courts located within Massachusetts for resolution of any disputes.
